Welcome to [pepti] (“[pepti],” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of our website, mobile applications, and services (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services.
1. Eligibility
You must be at least 18 years old and legally able to enter into binding contracts to use our Services. You must be located in the United States in a state where our Services are available. By using the Services, you represent and warrant that you meet these requirements and that all information you provide is true, accurate, current, and complete.
2. State Availability
Our Services are currently available in 45 U.S. states. However, the availability of specific treatments or medications may vary by state based on applicable laws and regulations. We do not currently offer Services outside the United States or to APO/FPO addresses. We reserve the right to modify the states in which Services are available at any time.
3. Nature of Services
[pepti] is a technology platform that connects users with independent licensed healthcare providers and FDA-registered 503A and 503B compounding pharmacies. [pepti] facilitates: (a) the gathering and retention of healthcare records and information for use in medical provider encounters; (b) administrative support in connection with scheduling and payment for healthcare services; (c) coordination of prescription fulfillment and payment for medications ordered by medical providers; and (d) telecommunications and technology support for telehealth consultations and assessments.
[pepti] is not a healthcare provider, pharmacy, or insurer, and does not engage in the practice of medicine or pharmacy. The healthcare providers who use the platform are independent contractors and are solely responsible for the medical care they provide.
4. Medical Disclaimer
The information provided on the Services, including by our AI assistant and AI wellness coach, is for general informational and educational purposes only and does not constitute medical advice, diagnosis, or treatment. Always seek the advice of a qualified healthcare provider with any questions you may have regarding a medical condition. Never disregard professional medical advice or delay seeking it because of something you have read on the Services.
The Services are not designed for medical emergencies. If you are experiencing a medical emergency, call 911 or go to your nearest emergency room immediately.
5. No Doctor-Patient Relationship
Your use of the Services does not create a doctor-patient relationship between you and [pepti]. A doctor-patient relationship is established only between you and the independent healthcare provider who reviews your intake and, if appropriate, prescribes treatment. [pepti] is not responsible for the medical decisions made by these independent providers.
6. Account Registration
To use certain features of the Services, you may be required to create an account. You agree to provide accurate, current, and complete information and to keep your account credentials secure. You are responsible for all activity that occurs under your account. You must immediately notify us of any unauthorized use of your account or any other breach of security.
7. HIPAA Compliance & Protected Health Information
We are HIPAA-compliant.[pepti] handles your Protected Health Information (“PHI”) in accordance with the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”) and its implementing regulations, including the Privacy Rule, the Security Rule, and the Breach Notification Rule.
Specifically, we maintain administrative, physical, and technical safeguards designed to protect the confidentiality, integrity, and availability of your PHI. These include:
- Encryption of PHI both in transit (TLS 1.2+) and at rest
- Role-based access controls — only your assigned licensed healthcare provider, authorized [pepti] administrators with a legitimate need, and our compounding pharmacy partners receive access to your PHI
- An immutable, append-only audit log capturing every access, view, modification, or transmission of your PHI
- Automatic session timeouts and multi-layer authentication for provider and administrator accounts
- Signed Business Associate Agreements (“BAAs”) with every third-party vendor that may store, transmit, or process your PHI, including our hosting provider, database provider, email provider, and payment processor
- Routine security reviews, vulnerability scanning, and incident response procedures
- Workforce training on HIPAA policies and security awareness
We use and disclose your PHI only as permitted by HIPAA — for treatment (sharing with your prescribing provider and dispensing pharmacy), payment (processing your subscription), healthcare operations (quality improvement, audit, customer support), and as required by law. We will never sell your PHI. We will not use your PHI for marketing without your prior written authorization.
You have the following rights under HIPAA, which you may exercise by emailing privacy@hellopepti.com:
- The right to receive a copy of our Notice of Privacy Practices
- The right to access and obtain a copy of your PHI
- The right to request corrections to your PHI
- The right to request restrictions on certain uses or disclosures
- The right to request confidential communications
- The right to receive an accounting of disclosures of your PHI
- The right to file a complaint, with us or with the U.S. Department of Health and Human Services
In the event of a breach involving your PHI, we will notify you within the timeframes required by the HIPAA Breach Notification Rule (no later than 60 days after discovery), and we will notify the Secretary of HHS and, where required, the media.

8. Subscription and Billing
Many of our treatments are offered as monthly subscriptions. By enrolling in a subscription, you authorize us to charge your payment method on a recurring basis until you cancel. Subscriptions automatically renew at the then-current price. You may cancel at any time through your account dashboard or by contacting customer support. All sales are final. Medical consultation fees are non-refundable. We cannot accept returns of prescription products for reuse or resale. You are exclusively and solely responsible for paying all fees due to receive the healthcare services provided to you. Since our providers are not contracted with any health insurance plan, any prescription medication ordered may not be covered by your insurance. See our Refund Policy for approved exceptions.
9. Prescription Treatments
All prescription treatments offered through the Services require evaluation and approval by a licensed healthcare provider. Treatment is not guaranteed. The provider may, in their sole medical judgment, determine that a particular treatment is not appropriate for you. If a provider denies your request, you will not be charged for the medication.
10. Compounded Medications
Many medications offered through the Services are compounded by FDA-registered 503A or 503B pharmacies. Compounded medications are not FDA-approved as products, although they may contain active ingredients that are FDA-approved. Compounded medications are prepared based on a prescription from a licensed healthcare provider for an individual patient. Compounded medications may not undergo the same testing or quality control as commercially manufactured FDA-approved drugs. The active pharmaceutical ingredients used by our partner pharmacies are sourced from FDA-registered facilities.
11. Off-Label Use
Many peptides and other medications offered through the platform are prescribed for off-label use. “Off-label” means the medication is being prescribed for a use, dose, or patient population that is not specifically approved by the FDA. Off-label prescribing is legal and common in U.S. medical practice when supported by clinical experience and professional medical judgment.
12. User Responsibilities & Restrictions on Use
You agree that you will not:
- Provide false, inaccurate, or misleading information during your medical intake
- Use the Services for any unlawful purpose
- Resell or redistribute any medication received through the Services
- Share, sell, or transfer any prescription medication to another person
- Attempt to interfere with, disrupt, or compromise the security of the Services
- Use the Services on behalf of another person without authorization
- Attempt to gain unauthorized access to any systems, networks, or data used by [pepti]
- Use any automated system, including bots, scrapers, or crawlers, to access the Services
- Reverse engineer, decompile, or disassemble any part of the Services
- Use the Services to develop a competing product or service
- Circumvent, disable, or interfere with any security features of the Services
- Distribute malware, viruses, or any other harmful code through the Services
- Access the Services from a jailbroken, rooted, or otherwise modified device, as doing so creates significant security risks for Protected Health Information and constitutes a material breach of these Terms
13. Intellectual Property
All content on the Services, including text, graphics, logos, images, software, and the [pepti] brand and trademarks, is the exclusive property of pepti LLC or its licensors and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, personal, non-transferable, non-commercial license to access and use the Services. You may not copy, reproduce, modify, distribute, publicly display, or create derivative works without our prior written permission.
14. Copyright Infringement (DMCA)
If you believe that any content on the Services infringes your copyright, please send a notice to legal@hellopepti.com with the following information: (a) identification of the copyrighted work claimed to have been infringed; (b) identification of the allegedly infringing material and its location on the Services; (c) your contact information; (d) a statement that you have a good faith belief that the use is not authorized; and (e) a statement under penalty of perjury that the information in the notice is accurate and that you are the copyright owner or authorized to act on their behalf.
15. Disclaimer of Warranties
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE MAKE NO WARRANTY REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY CONTENT ON THE SERVICES.
16. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, [PEPTI] AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
THE TOTAL LIABILITY OF [PEPTI] FOR ANY AND ALL CLAIMS ARISING UNDER THESE TERMS OR RELATING TO THE SERVICES SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100.00 USD).
17. Indemnification
You agree to indemnify, defend, and hold harmless [pepti] and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorney's fees) arising out of your use of the Services, your violation of these Terms, your provision of false or misleading information, or your violation of any rights of another party.
18. Suspension and Termination
We may suspend or terminate your access to the Services at any time, with or without cause, and with or without notice. Upon termination, your right to use the Services will immediately cease. We may also remove or disable access to any content in our sole discretion. Any provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability.
19. Dispute Resolution & Arbitration
Informal resolution first. In the event of a dispute, you and [pepti] agree to first attempt to resolve it informally. You must send a written description of the dispute to legal@hellopepti.com. If the dispute is not resolved within 60 days of receipt of the written notice, either party may proceed to arbitration.
Binding arbitration. Any dispute arising out of or relating to these Terms or the Services that is not resolved informally shall be resolved through binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration shall be conducted in the English language. Judgment on the award rendered by the arbitrator may be entered in any court of competent jurisdiction.
Class action waiver. You and [pepti] may bring claims against the other only on an individual basis and not on a class, collective, representative, or mass action basis. You waive your right to participate in a class action, class arbitration, or any other representative proceeding.
30-day opt-out window. You may opt out of this arbitration agreement by sending written notice within 30 days of first accepting these Terms or first using the Services (whichever is later). The notice must include your full name, mailing address, email associated with your account, and a clear statement that you are opting out of arbitration. Send the notice via one of the following:

Opting out of arbitration will not affect any other provision of these Terms or any other agreement you have with [pepti].
20. Modifications to the Services
We reserve the right to modify, suspend, or discontinue any part of the Services at any time, with or without notice and without liability to you. We may also impose limits on certain features or restrict your access to parts of the Services without notice or liability.
21. Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to its conflict of laws principles.
22. Changes to These Terms
We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the Services and updating the “Last updated” date. Your continued use of the Services after changes become effective constitutes your acceptance of the modified Terms. If you do not agree with the modified Terms, you must discontinue use of the Services.
23. Miscellaneous
These Terms constitute the entire agreement between you and [pepti] regarding the Services and supersede all prior agreements. If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. You may not assign or transfer these Terms without our prior written consent.
